WHERE MARIACHIS AND MINUTEMEN COLLIDE

Showdown in Arizona, Where Mariachis and Minutemen Collide

By LAWRENCE DOWNES

Published: December 10, 2007

PHOENIX — Want to see America unraveling? Come here, to Thomas Road and 35th Street, to M. D. Pruitt’s furniture store. Come on Saturday morning and stand near the eight delivery trucks barricading the parking lot, like the wall of an urban Alamo.

For the last seven weeks, a sidewalk protest here by Latino immigrants has blossomed into a feverish reality show, attracting Minutemen, mariachis, children dancing in Mexican folk costumes, white racists, United Nations observers, Phoenix police officers and Maricopa County sheriff’s deputies.

The weekly confrontation — strident and stalemated — perfectly mimics the national debate. But it’s a sideshow to something even uglier: what happens when immigration’s complexities are handed to local law enforcers sympathetic to the fury of one side.

Thomas Road has lots of Latino day laborers, or jornaleros, who hustle for work near Home Depot. A few months ago, the Phoenix police shooed them away. They dispersed to streets nearby, angering local businesses. One of the biggest, Pruitt’s, hired off-duty city police officers to keep jornaleros at bay. The city put a stop to that, so Pruitt’s turned to the county sheriff, Joe Arpaio.

Sheriff Joe, as he is known, needed no prodding: hunting undocumented immigrants is his specialty. He has arrested hundreds under a state antismuggling law (for smuggling themselves) and has had 160 officers deputized as federal immigration agents. They have made more than 50 arrests near Pruitt’s since the protests began.

They’ll pull a car over for a traffic infraction, then check everyone’s papers. They say they act on reasonable suspicion only — if they see a shirt or shoes like those worn south of the border or hear Spanish. They say it isn’t profiling.

There is no doubt whose side Sheriff Joe is on. He has officers on Pruitt’s payroll, guarding the lot on protest days. Last week, he issued a news release demanding that the demonstrators stop hurting Pruitt’s and vowing to crank up the pressure until they went away. It was a naked attempt to stifle dissent and help a business ally.

People here are used to that from Sheriff Joe. He describes himself as “America’s meanest sheriff” and has recently been basking in the love of nativists like the Minuteman Chris Simcox and radio host Terry Anderson, who gushed over him at a roast in Sun City West this month.

If Arizona begins punishing companies that hire illegal workers under a state law that takes effect Jan. 1 — a lawsuit to block it was thrown out Friday — it will fall to counties to do the purge. In Maricopa, that means Sheriff Joe.

The protests at Pruitt’s are the only real opposition he has faced. Their leader is Salvador Reza, a stocky American of Mexican and Apache ancestry, an Air Force veteran who has spent years organizing jornaleros and small-business owners here.

Mr. Reza says he can’t understand why America accepts global flows of companies, money and jobs but not workers. Why faith in market forces seems to have been eclipsed by fear of immigrants. Or why the country cannot set up legal channels to let jornaleros come and go and not be hassled. “They actually are people with a work ethic that would make the Puritans proud,” he said.

Pruitt’s owner, Roger Sensing, says he needs armed officers to protect customers from jornaleros. Mr. Reza calls that ridiculous, and one informed noncombatant, the Rev. Craig Geiger, pastor of a Lutheran church across the street, agrees. He told me he had never seen a laborer enter Pruitt’s lot. He also said his Latino congregation did not drive to church anymore. Documented or not, they fear Sheriff Joe. They walk.

Pastor Geiger leaves the neighborhood on Saturdays, because it gets deafening. When I was there, a trio singing Mexican ballads strolled through the crush. A Minuteman with a bullhorn followed them. “Monkeys coming through!” he shouted. His side rushed up to drown the music out: “Born in the U.S.A.! Born in the U.S.A.! K.K.K.! Viva la Migra! January First!”

The restrictionists see Jan. 1 as the dawn of a new era, when the Mexicans disappear and everything gets pure and legal again. It is uncertain whether Arizona’s economy will survive the exodus. “Unfortunately, they’ll probably wake up when they bankrupt the state,” Mr. Reza told me.

WHEN IS TORTURE OK?

Waterboarding in Viet-Nam a few years ago.

When Is Torture OK?

Is it permissible when all you do is scare the 'detainee' out of his wits? Or maybe, scare him enough that he feels as if he were about to be killed? Do you stifle him to the point when he's about to suffocate? Do you ring his neck to the point when he gags, and gasps for breath?. Can you smother him with a pillow until he admits guilt?
We can probably learn quite a bit from the Red Chinese, or The Third Reich, on the most effective means of Torture. Whether it's for in-terror-gation, or for punishment.

All these questions may seem cynical or maybe, irreverent, but, I'm honestly curious. When can torture be considered warranted? In our humane society where we punish people for being cruel to pets and other animals. Yet, we condone 'petit' torture.
What's good for the goose, isn't good for the gent-d'arme?

We've come a long way in the recent reversal of established protocols of war. When I was in the Armed Forces, we were obliged to abide by the Geneva Convention Agreement. Now, It seems that it is optional; And can be adhered to as the situation arises. When candidates for Cabinet positions can be questioned by Congress; 'If they think that waterboarding is torture; And get a rhetorical: I duh kno'. Things have changed so drastically, that I wonder if we can still call our society civilized? Then, some wonder why is our society so violent? Why are there so many children on Ritalin? Why is there so much gang violence? Why do young men go on shooting rampages and kill indiscriminately, and maim innocent victims?

The new crime fighting tactic is to taze, shoot, then ask questions. Are we seeing a world and our nation going berserk? I definitely believe we are. It's a MADMAX world, we're living in. Might makes right. Where up is down, and Good is bad. Long live the whales, stop global warming, etc. Yet, violence is used to achieve peace by governmental bodies.
We are told to the Christ-Mass spirit is in the air, be good consumers and act "business as usual".

And of course, do as I say, not as I do!

CNN) -- A gunman attacked worshippers at a Colorado Springs, Colorado, megachurch Sunday afternoon, killing one person and wounding four others before being killed by a security staff member, the city's police chief said.

Emergency vehicles gather near New Life Church in Colorado Springs on Sunday.

Chief Richard Myers called the person "a courageous security staff member who probably saved many lives today."

He said some of the shooting victims being treated at the hospital have life-threatening injuries.

Several "suspicious devices" were found at the church, Myers said.

SWAT teams were clearing the multiple buildings at New Life Church, along with an explosives unit, he said.

Rev. Brady Boyd, senior pastor of New Life Church, said the church had a security plan in place.

"I'm proud of the way our team responded today," he said. "Many, many lives were saved because of the quick action of some committed volunteers at our church." Video Watch as a church member describes what he saw »

Police know neither the motive for the attack nor of any relationship between the suspect and the victims.

Police spokesman Lt. Fletcher Howard said area businesses were placed on lockdown after the shooting "to make sure there's not any other suspects at large."

The shooting occurred about 12 hours after a shooting at a missionary training center in Arvada, outside Denver, Colorado, left two people dead and two wounded. The gunman in that incident was still at large Sunday afternoon.

There was no known connection between the two incidents Sunday afternoon, Howard said, but he did not rule out that possibility. Arvada and Colorado Springs are about 80 miles apart.

New Life Church is on the northwestern outskirts of Colorado Springs, near the U.S. Air Force Academy. The non-denominational church claims a membership of more than 10,000.

The church was founded by the Rev. Ted Haggard, an evangelical Christian leader who was ousted in 2006 after allegations that he had been a client of a male prostitute from whom he had purchased drugs. Haggard admitted to undisclosed "sexual immorality" and called himself "a deceiver and a liar" in a letter to the congregation.

Gunman opens fire in Colorado Christian missionary training center, wounds 4

Sunday, December 9, 2007

DENVER - A gunman walked into a training center for young Christian missionaries in a Denver suburb early Sunday and opened fire, wounding at least four people.

The shooting happened at about 12:30 a.m. (0630GMT) on Sunday at the Youth With a Mission center, Arvada Police spokeswoman Susan Medina said.

The extent of the injuries was not clear, and the gunman was still at large Sunday morning.

According to its Web site, Youth With a Mission has about 1,000 locations worldwide and trains people to become missionaries. About 50 people were inside the Arvada site when the gunman opened fire.

THE WISDOM OF GOD

1 Corinthians 2

1And I, brethren, when I came to you, came not with excellency of speech or of wisdom, declaring unto you the testimony of God.

2For I determined not to know any thing among you, save Jesus Christ, and him crucified.

3And I was with you in weakness, and in fear, and in much trembling.

4And my speech and my preaching was not with enticing words of man's wisdom, but in demonstration of the Spirit and of power:

5That your faith should not stand in the wisdom of men, but in the power of God.

6Howbeit we speak wisdom among them that are perfect: yet not the wisdom of this world, nor of the princes of this world, that come to nought:

7But we speak the wisdom of God in a mystery, even the hidden wisdom, which God ordained before the world unto our glory:

8Which none of the princes of this world knew: for had they known it, they would not have crucified the Lord of glory.

9But as it is written, Eye hath not seen, nor ear heard, neither have entered into the heart of man, the things which God hath prepared for them that love him.

10But God hath revealed them unto us by his Spirit: for the Spirit searcheth all things, yea, the deep things of God.

11For what man knoweth the things of a man, save the spirit of man which is in him? even so the things of God knoweth no man, but the Spirit of God.

12Now we have received, not the spirit of the world, but the spirit which is of God; that we might know the things that are freely given to us of God.

13Which things also we speak, not in the words which man's wisdom teacheth, but which the Holy Ghost teacheth; comparing spiritual things with spiritual.

14But the natural man receiveth not the things of the Spirit of God: for they are foolishness unto him: neither can he know them, because they are spiritually discerned.

15But he that is spiritual judgeth all things, yet he himself is judged of no man.

16For who hath known the mind of the Lord, that he may instruct him? but we have the mind of Christ.

THE TESTIMONIES SLIGHTED (EXCERPT)

I have been shown that the spirit of the world is fast leavening the church. You are following the same path as did ancient Israel. There is the same falling away from your holy calling as God's peculiar people. You are having fellowship with the unfruitful works of darkness. Your concord with unbelievers has provoked the Lord's displeasure. You know not the things that belong to your peace, and they are fast being hid from your eyes. Your neglect to follow the light will place you in a more unfavorable position than the Jews upon whom Christ pronounced a woe.

I have been shown that unbelief in the testimonies has been steadily increasing as the people backslide from God. It is all through our ranks, all over the field. But few know what our churches are to experience. I saw that at present we are under divine forbearance, but no one can say how long this will continue. No one knows how great the mercy that has been exercised toward us. But few are heartily devoted to God. There are only a few who, like the stars in a tempestuous night, shine here and there among the clouds.

Many who complacently listen to the truths from God's word are dead spiritually, while they profess to live. For years they have come and gone in our congregations, but they seem only less and less sensible of the value of revealed truth. They do not hunger and thirst after righteousness. They have no relish for spiritual or divine things. They assent to the truth, but are not sanctified through it. Neither the word of God nor the testimonies of His Spirit make any lasting impression upon them. Just according to the light, the privileges, and opportunities which they have slighted will be their condemnation. Many who preach the truth to others are themselves cherishing iniquity. The entreaties of the Spirit of God, like divine melody, the promises of His word so rich and abundant, its threatenings against idolatry and disobedience--all are powerless to melt the world-hardened heart.

WHY PROBATION LINGERS

Why Probation Lingers

The Lord is not slack concerning his promise, as some men count slackness; but is longsuffering to us-ward, not willing that any should perish, but that all should come to repentance. 2 Peter 3:9.

I was shown our danger, as a people, of becoming assimilated to the world rather than to the image of Christ. We are now upon the very borders of the eternal world, but it is the purpose of the adversary of souls to lead us to put far off the close of time. Satan will in every conceivable manner assail those who profess to be the commandment-keeping people of God and to be waiting for the second appearing of our Saviour in the clouds of heaven with power and great glory. He will lead as many as possible to put off the evil day and become in spirit like the world, imitating its customs. I felt alarmed as I saw that the spirit of the world was controlling the hearts and minds of many who make a high profession of the truth. . . .

In consideration of the shortness of time we as a people should watch and pray, and in no case allow ourselves to be diverted from the solemn work of preparation for the great event before us. Because the time is apparently extended, many have become careless and indifferent in regard to their words and actions. They do not realize their danger and do not see and understand the mercy of our God in lengthening their probation, that they may have time to form characters for the future, immortal life. Every moment is of the highest value. Time is granted them, not to be employed in studying their own ease and becoming dwellers on the earth, but to be used in the work of overcoming every defect in their own characters and in helping others, by example and personal effort, to see the beauty of holiness. God has a people upon the earth who in faith and holy hope are tracing down the roll of fast-fulfilling prophecy and are seeking to purify their souls by obeying the truth, that they may not be found without the wedding garment when Christ shall appear. . . .

The signs foretold in prophecy are fast fulfilling around us. This should arouse every true follower of Christ to zealous action.

TO THE LAODECIAN CHUCH OF LATTER TIMES

14And unto the angel of the church of the Laodiceans write; These things saith the Amen, the faithful and true witness, the beginning of the creation of God;

15I know thy works, that thou art neither cold nor hot: I would thou wert cold or hot.

16So then because thou art lukewarm, and neither cold nor hot, I will spue thee out of my mouth.

17Because thou sayest, I am rich, and increased with goods, and have need of nothing; and knowest not that thou art wretched, and miserable, and poor, and blind, and naked:

18I counsel thee to buy of me gold tried in the fire, that thou mayest be rich; and white raiment, that thou mayest be clothed, and that the shame of thy nakedness do not appear; and anoint thine eyes with eyesalve, that thou mayest see.

19As many as I love, I rebuke and chasten: be zealous therefore, and repent.

20Behold, I stand at the door, and knock: if any man hear my voice, and open the door, I will come in to him, and will sup with him, and he with me.

21To him that overcometh will I grant to sit with me in my throne, even as I also overcame, and am set down with my Father in his throne.

22He that hath an ear, let him hear what the Spirit saith unto the churches.------Revelation 3:14-22.

-*---------*-

33Hear another parable: There was a certain householder, which planted a vineyard, and hedged it round about, and digged a winepress in it, and built a tower, and let it out to husbandmen, and went into a far country:

34And when the time of the fruit drew near, he sent his servants to the husbandmen, that they might receive the fruits of it.

35And the husbandmen took his servants, and beat one, and killed another, and stoned another.

36Again, he sent other servants more than the first: and they did unto them likewise.

37But last of all he sent unto them his son, saying, They will reverence my son.

38But when the husbandmen saw the son, they said among themselves, This is the heir; come, let us kill him, and let us seize on his inheritance.

39And they caught him, and cast him out of the vineyard, and slew him.

40When the lord therefore of the vineyard cometh, what will he do unto those husbandmen?

41They say unto him, He will miserably destroy those wicked men, and will let out his vineyard unto other husbandmen, which shall render him the fruits in their seasons.

42Jesus saith unto them, Did ye never read in the scriptures, The stone which the builders rejected, the same is become the head of the corner: this is the Lord's doing, and it is marvellous in our eyes?

43Therefore say I unto you, The kingdom of God shall be taken from you, and given to a nation bringing forth the fruits thereof.

44And whosoever shall fall on this stone shall be broken: but on whomsoever it shall fall, it will grind him to powder.

45And when the chief priests and Pharisees had heard his parables, they perceived that he spake of them.

46But when they sought to lay hands on him, they feared the multitude, because they took him for a prophet. ------Matthew 21:33-46.

-*---------*-

Matthew 23

1Then spake Jesus to the multitude, and to his disciples,

2Saying The scribes and the Pharisees sit in Moses' seat:

3All therefore whatsoever they bid you observe, that observe and do; but do not ye after their works: for they say, and do not.

4For they bind heavy burdens and grievous to be borne, and lay them on men's shoulders; but they themselves will not move them with one of their fingers.

5But all their works they do for to be seen of men: they make broad their phylacteries, and enlarge the borders of their garments,

6And love the uppermost rooms at feasts, and the chief seats in the synagogues,

7And greetings in the markets, and to be called of men, Rabbi, Rabbi.

8But be not ye called Rabbi: for one is your Master, even Christ; and all ye are brethren.

9And call no man your father upon the earth: for one is your Father, which is in heaven.

10Neither be ye called masters: for one is your Master, even Christ.

11But he that is greatest among you shall be your servant.

12And whosoever shall exalt himself shall be abased; and he that shall humble himself shall be exalted.

13But woe unto you, scribes and Pharisees, hypocrites! for ye shut up the kingdom of heaven against men: for ye neither go in yourselves, neither suffer ye them that are entering to go in.

14Woe unto you, scribes and Pharisees, hypocrites! for ye devour widows' houses, and for a pretence make long prayer: therefore ye shall receive the greater damnation.

15Woe unto you, scribes and Pharisees, hypocrites! for ye compass sea and land to make one proselyte, and when he is made, ye make him twofold more the child of hell than yourselves.

16Woe unto you, ye blind guides, which say, Whosoever shall swear by the temple, it is nothing; but whosoever shall swear by the gold of the temple, he is a debtor!

17Ye fools and blind: for whether is greater, the gold, or the temple that sanctifieth the gold?

18And, Whosoever shall swear by the altar, it is nothing; but whosoever sweareth by the gift that is upon it, he is guilty.

19Ye fools and blind: for whether is greater, the gift, or the altar that sanctifieth the gift?

20Whoso therefore shall swear by the altar, sweareth by it, and by all things thereon.

21And whoso shall swear by the temple, sweareth by it, and by him that dwelleth therein.

22And he that shall swear by heaven, sweareth by the throne of God, and by him that sitteth thereon.

23Woe unto you, scribes and Pharisees, hypocrites! for ye pay tithe of mint and anise and cummin, and have omitted the weightier matters of the law, judgment, mercy, and faith: these ought ye to have done, and not to leave the other undone.

24Ye blind guides, which strain at a gnat, and swallow a camel.

25Woe unto you, scribes and Pharisees, hypocrites! for ye make clean the outside of the cup and of the platter, but within they are full of extortion and excess.

26Thou blind Pharisee, cleanse first that which is within the cup and platter, that the outside of them may be clean also.

27Woe unto you, scribes and Pharisees, hypocrites! for ye are like unto whited sepulchres, which indeed appear beautiful outward, but are within full of dead men's bones, and of all uncleanness.

28Even so ye also outwardly appear righteous unto men, but within ye are full of hypocrisy and iniquity.

29Woe unto you, scribes and Pharisees, hypocrites! because ye build the tombs of the prophets, and garnish the sepulchres of the righteous,

30And say, If we had been in the days of our fathers, we would not have been partakers with them in the blood of the prophets.

31Wherefore ye be witnesses unto yourselves, that ye are the children of them which killed the prophets.

32Fill ye up then the measure of your fathers.

33Ye serpents, ye generation of vipers, how can ye escape the damnation of hell?

34Wherefore, behold, I send unto you prophets, and wise men, and scribes: and some of them ye shall kill and crucify; and some of them shall ye scourge in your synagogues, and persecute them from city to city:

35That upon you may come all the righteous blood shed upon the earth, from the blood of righteous Abel unto the blood of Zacharias son of Barachias, whom ye slew between the temple and the altar.

36Verily I say unto you, All these things shall come upon this generation.

37O Jerusalem, Jerusalem, thou that killest the prophets, and stonest them which are sent unto thee, how often would I have gathered thy children together, even as a hen gathereth her chickens under her wings, and ye would not!

38Behold, your house is left unto you desolate.

39For I say unto you, Ye shall not see me henceforth, till ye shall say, Blessed is he that cometh in the name of the Lord.

BE SINGULAR--FOR CHRIST'S SAKE

Be Singular--for Christ's Sake

Thou shalt not follow a multitude to do evil; neither shalt thou speak in a cause to decline after many to wrest judgment. Ex. 23:2. {UL 315.1}

To be singular for singularity's sake is positively detestable, below the dignity of a Christian, but to be singular because it is necessary to be so as the result of worshipping God and Him only, places Heaven's dignity upon man. We must not be afraid of being singular when duty requires us to be thus to exalt and honor God. . . .

Do not court singularity for the sake of being odd, but for the sake of avoiding sin and dishonor to God. And in this case we are not to mind even the multitude who are against us. "Thou shalt not follow a multitude to do evil."

Because the law of God is made void in our world, does it make it a virtue to transgress that law? It may appear to the world a very small matter for the Christian to be in harmony with the world by just the act of keeping Sunday for the Sabbath in the place of the seventh day, but God's Word says the seventh day is My holy day. The man of sin says, "I make a Sabbath for you and you must keep the first day of the week." . . .

God has a church. It is not the great cathedral, neither is it the national establishment, neither is it the various denominations; it is the people who love God and keep His commandments. "Where two or three are gathered together in my name, there am I in the midst of them" (Matt. 18:20). Where Christ is even among the humble few, this is Christ's church, for the presence of the High and Holy One who inhabiteth eternity can alone constitute a church.

Where two or three are present who love and obey the commandments of God, Jesus there presides, let it be in the desolate place of the earth, in the wilderness, in the city enclosed in prison walls. The glory of God has penetrated the prison walls, flooding with glorious beams of heavenly light the darkest dungeon. His saints may suffer, but their sufferings will, like the apostles of old, spread their faith and win souls to Christ and glorify His holy name. The bitterest opposition expressed by those who hate God's great moral standard of righteousness should not and will not shake the steadfast soul who trusts fully in God. . . .

They that will be doers of the word are building securely, and the tempest and storm of persecution will not shake their foundation, because their souls are rooted to the eternal Rock.--Letter 108, Oct. 28, 1886, to her older sister and her husband who had not accepted the Sabbath truth.

WHEN THE ROLL IS CALLED UP YONDER

WHEN THE ROLL IS CALLED UP YONDER

When the trumpet of the Lord shall sound, and time shall be no more,
And the morning breaks, eternal, bright and fair;
When the saved of earth shall gather over on the other shore,
And the roll is called up yonder, I’ll be there.

Refrain

When the roll, is called up yon-der,
When the roll, is called up yon-der,
When the roll, is called up yon-der,
When the roll is called up yonder I’ll be there.

On that bright and cloudless morning when the dead in Christ shall rise,
And the glory of His resurrection share;
When His chosen ones shall gather to their home beyond the skies,
And the roll is called up yonder, I’ll be there.

Refrain

Let us labor for the Master from the dawn till setting sun,
Let us talk of all His wondrous love and care;
Then when all of life is over, and our work on earth is done,
And the roll is called up yonder, I’ll be there.

SUPREME COURT HEARS GUANTANAMO CASE

Supreme Court Hears Guantanamo Arguments

Morning Edition, December 6, 2007 · The Supreme Court hears arguments for a third time in a case involving whether the prisoners classified as enemy combatants and held at Guantanamo Bay are entitled to challenge their detention in U.S. courts. The prisoners have been held for six years.

All Things Considered, December 5, 2007 · On Wednesday, the U.S. Supreme Court heard arguments for a third time in a major case involving the rights of detainees at Guantanamo Bay, Cuba. The importance of the case was underlined by the fact that for the first time this term, the court authorized the same day release of audio of the argument.

Even the pre-dawn snowfall did not deter about 73 people from sleeping on the Supreme Court plaza in hopes of getting one of the few public seats for Wednesday's argument. This was a historic day at the high court, and everyone knew it.

The question facing the court is whether the detainees have the right to go into the U.S. courts to challenge their detentions, using the constitutionally guaranteed procedure called a writ of habeas corpus. The Founding Fathers put the writ into the Constitution as a check on the government's power to arbitrarily put someone in prison.

But the Bush administration, backed by the federal appeals court in Washington, contends that the detainees have no constitutional rights because they are being held outside the United States, and that even if they do, the Constitution allows suspension of the writ of habeas corpus if an alternative is put into place that is adequate and effective.

The Bush administration argues that Congress approved just such an alternative when it stripped the courts of the right to hear the detainees' habeas corpus challenges. The detainees, however, counter that the system for evaluating them is so rigged as to be unconstitutional, because they are denied lawyers, denied access to much of the evidence against them, and because the Combat Status Review Tribunals are subject to command influence and presume the government's evidence to be accurate.

What's more, the detainees note that they have no right to appeal or present their own evidence, that only one court, the D.C. Court of Appeals, is allowed to hear their cases, and the statute passed by Congress only allows that court to evaluate whether the tribunals followed their own procedures — procedures that the detainees claim are deeply flawed.

Inside the court Wednesday, the argument was mano a mano — current Solicitor General of the United States Paul Clement versus a former solicitor general, Seth Waxman. Waxman went first, contending that his clients should have the right to challenge their detentions in the U.S. courts.

"All have been confined at Guantanamo for almost six years," Waxman said, "yet not one has ever had meaningful notice of the factual grounds of detention or a fair opportunity to dispute those grounds before a neutral decision-maker."

"Your argument wouldn't be any different with respect to the availability of habeas if these people were held for one day, would it?" Chief Justice John Roberts asked.

"I want to give a qualified disagreement with your hypothetical," Waxman replied. "There may be military exigencies. There may be a limited time period in which it is inappropriate for a habeas court to rule."

Justices Samuel Alito and Ruth Bader Ginsburg wondered whether detainees held at other bases in Germany or Iraq, for instance, would also have a right to habeas corpus. Waxman said that Guantanamo is different because it is the only place where U.S. law has exclusive jurisdiction.

"In another place, jurisdiction would depend on the facts and circumstances, including the nature of an agreement with the resident sovereign over who exercises control," Waxman said.

Justice Antonin Scalia intervened at this point to suggest that the detainees are making an unprecedented argument.

"Do you have a single case in the 220 years of our country, or for that matter, in the five centuries of the English empire, in which habeas was granted to an alien in a territory that was not under the sovereign control of either the United States or England?" Scalia asked.

"The answer to that is a resounding yes," Waxman said.

Waxman and Scalia then squabbled for several minutes over the meaning and circumstances of previous cases dating back to the 1700s.

Justice Alito followed up, asking, "What if in a future war many of the soldiers in the opposing army don't wear uniforms? What if it's a war like Vietnam and thousands of prisoners are taken into custody and they are brought to prisoner-of-war camps in the United States as occurred during WWII? Every one of them, under your theory, could file a habeas petition."

Waxman replied that in Vietnam — the only other war in which the U.S. fought an enemy that didn't wear uniforms — captured enemy combatants were accorded hearings close to the battlefield, were assigned lawyers, and, he said, there is no indication that the captured men were denied access to the evidence being used against them.

In short, Waxman said, there was fair notice of the facts and the chance to rebut them, as well as a neutral decision-maker who was insulated from command influence.

Justice Anthony Kennedy, widely believed to be the deciding vote in this case, asked whether habeas proceedings should wait until the D.C. Court of Appeals rules on whether the CSRT hearings have followed the procedures established as an alternative to habeas corpus.

To date, replied Waxman, the CSRT hearings have been largely in secret, without the detainee present, and with the presumption that the evidence against each one is accurate. That's the procedure set down in the Detainee Treatment Act.

"There is no prospect that the DTA proceedings will be conducted with alacrity or certainty," Waxman replied. "In the court of appeals, Justice Kennedy, the government after two years has not produced the record on review in a single case. It is now said ... that it cannot do so. And the court of appeals has suggested that what the government ought to do is hold entirely new CSRT proceedings."

Following Waxman to the lectern, Solicitor General Clement all but threw in the towel on some of the argument the Bush administration made in its briefs to the court. Yes, Clement seemed to say, the appeals process for detainees is very limited, but the Supreme Court can pretty much do anything it wants to broaden the appeal rights of the detainees.

Chief Justice Roberts said that the law passed by Congress stripping the detainees of habeas rights is unclear as to whether the appeals court can order a detainee released. If there is a defect in a hearing, Clement said, the appeals court should order a new CSRT hearing.

But Clement added, "If what the Constitution requires to make the DTA to be an adequate substitute is the power to order release, there is no obstacle in the text of the DTA to that."

Justice David Souter observed that in past cases, the government has required repeated CSRT hearings until the desired verdict is achieved. Only the right of habeas corpus contains with it, he suggested, the ultimate sanction of ordering a detainee's release.

Clement replied, in essence, that the court should not supplant the considered judgments of the other branches of government.

"It really does represent the best efforts of the political branches, both political branches, to try to balance the interest in providing the detainees in this admittedly unique situation additional process with the imperative to successfully prosecute the global war on terror," Clement said.

Justice Stephen Breyer then tried to focus on the core claim of the detainees: that they are innocent. Where in the current appeals process can a detainee make that claim?

"I'm not sure that he can make that argument," Clement said.

"If he cannot make that argument, then how does this become an equivalent to habeus, since that happens to be the arument that a large number of these 305 people would like to make?" Justice Bryer asked.

Clement reiterated the government's argument that never before in the history of warfare has a U.S. prisoner of war had a right to challenge his detention with a habeas corpus petition in the U.S. courts.

"The problem with your prisoner-of-war point is, the United States is not treating them as prisoners of war. That argument, on the government's part, is entirely circular," said Justice Souter.

Justice Alito then posed this question: "If the court holds that the DTA is not an adequate substitute for habeas, what will happen? Will these petitioners then have access to all of the procedures that normally apply in habeas proceeding under 2242? The same right to discovery, subpoena, witnesses, access to classified information, presence in court?"

"The government will certainly take the position that they are not entitled to those things," Clement said. "Presumably, the petitioners will be arguing that they are entitled to those things. And there will be difficult questions that will need to be worked out."

Clement argued that the court would be jumping the gun, as it were, if it were to rule at this point that the detainees have habeas rights. The process should be allowed to play out first, he said. That prompted this question from Justice John Paul Stevens:

"They say they have been unlawfully detained for six years from the beginning," Justice Stevens said. "And isn't that delay relevant to question whether they haven't been provided such a wonderful set of procedures?"

"Well, Justice Stevens," Clement replied, "I think the delay is going to be relevant in whether or not courts should expedite hearings and the like, but I don't think it should cloud the basic constitutional question before this court."

Chief Justice Roberts tried to rescue Clement at this point, noting that the CSRT procedures were not in place until 2004.

"Habeas is supposed to be speedy," Justice Breyer countered. "And yet people have serious arguments anyway that they're being held for six years without even having those arguments heard. Is there anything, in your opinion, that this court could say by way of remedy that could get the D.C. circuit or the others to decide this and the CSRT claims, there are 305 people, to do this quickly in a matter of months rather than six more years?"

Solicitor General Clement replied that the court could instruct the lower court to expedite the appeals process. But justices Kennedy and Souter observed that under the statute passed by Congress, the Supreme Court has no jurisdiction in these cases.

"How can we say that? Justice Souter asked. "Your position is that we have no jurisdiction here. If you win, we never get to these issues."

The final argument of the day was the rebuttal from former Solicitor General Waxman. The writ of habeas corpus, he contended, has always allowed prisoners to challenge their detention if they claim they are not warriors and are being wrongly held. The current system, he argued, does not allow for such an argument.

To illustrate his point, Waxman pointed to a case in which he said a detainee was finally released after four years in detention because the detainee, a German man, had "what other detainees have not had — a lawyer." And when the lawyer filed a habeas petition in the federal courts, and the government filed a reply with its evidence, the lawyer saw that the government claimed the detainee had associated with a named terrorist who had blown himself up.

"Within 24 hours, his counsel had affidavits not only from the German prosecuter, but from the supposedly deceased Mr. Bilgen, who is a resident of Dresden, never involved in terrorism, and fully getting on with his life," Waxman said.

That evidence would not have been allowed under the CSRT hearing and appeals process, Waxman said, and that's why the process is inadequate.

The justices appeared to be split 4-4, with Justice Kennedy holding the tie-breaking vote.

HR 1592: HATE CRIMES LEGISLATION

Congress debates 'jail grandma' hate speech
Warnings issued over 'most dangerous bill in America'

Debate has been launched in Congress on a federal "hate speech" proposal similar to a state law that already has been used to send grandmothers to jail for their "crime" of sharing the Gospel of Jesus on a Philadelphia public sidewalk. And Brad Dacus of the Pacific Justice Institute told members that "our society needs to heed voices of conscience – not haul them into court."

"This is the most dangerous bill in America," said Janet Folger, a WND columnist and the president of Faith2Action, which has launched an advertising campaign on the issue.

Dacus said in comments prepared for presentation to the House Judiciary Committee's Subcommittee on Crime, Terrorism and Homeland Security that H.R. 1592 would use the power and authority of the federal government to stifle free speech, especially religious speech.

He talked about the misuse of "hate crimes" laws that give those claiming "sexual orientation" or "gender identity" discrimination special legal rights, pointing out that such a maneuver recently was used, as WND has reported, by the Hindu American Foundation to label a long list of Christian ministry websites who promote Christian beliefs and offer the choice of those beliefs to those involved in other religions as "hate speech."

"What makes America great is its tolerance for a diversity of viewpoints – even viewpoints we may not agree with. H.R. 1592 is a smokescreen for stifling dissent on important issues of national debate such as sexual orientation, gender identity and religion," he said.

"This so-called 'hate crime' legislation begins to lay the legal foundation and framework for investigating, prosecuting and persecuting pastors, business owners, and anyone else whose actions reflect their faith – as has already been starkly demonstrated in California, Canada, Europe and Australia," he said.

The proposal, on its face, would create bans on "hate crimes," but Rev. Louis Sheldon of the Traditional Values Coalition said it more accurately is "an attempt by the ultra liberals and the homosexuals to force Americans to accept homosexuality and gender disturbance as equal to God's Created Order of heterosexuality."

His organization is running an e-mail campaign to alert members of Congress about their constituents' concerns.

"This bill says that hordes of homosexuals are being forced to flee their home states because they are routinely denied access to goods, services and employment," he said. "This explains the mystery of the crowded highways and airports in San Francisco and New York. … The reasons for the bill are completely unsupported."

He said states already have the resources to deal with crimes of bodily harm or assault, and the plan is simply not needed. Worse yet, he said, it creates a crime of "thought."

Sheldon's organization is releasing a poster showing Jesus as a wanted fugitive, for "crimes" under the planned "hate crimes" legislation.

Folger said her organization is launching a national television campaign to fight so-called "hate crimes" legislation, starting with H.R. 1592, the pending plan.

"The 'Hate Crimes' bill is better named 'Hate Grandma' or "hate Free Speech' bill as it poses a serious threat to the freedom of speech for every American," Folger said. "We must stop it before they send your grandma, your pastor, or you to jail for sharing your faith or speaking the truth about an agenda that seeks to silence us."

The television ad campaign by Faith2Action will feature Philadelphia grandmothers who already were thrown in jail in Pennsylvania under that state's "hate crimes" law – and faced the possibility of 47 years in jail – for testifying in public about their Christian faith.

That ads can be viewed at StopHateCrimesNow.com.

Sheldon noted that the plan adds "sexual orientation" and "gender identity" – "perceived or actual" for special federal protection under the Commerce Clause. The plan already is on the fast track, with the possibility of being reviewed by the full Judiciary Committee next week.

The National Prayer Network, led by Rev. Ted Pike, is promoting a campaign aimed at defeating "hate crimes" proposals

The proposal, by U.S. Rep. John Conyers, the head of the House Judiciary Committee, is called "The Local Law Enforcement Hate Crimes Prevention Act of 2007," and the Rev. Ted Pike, of the National Prayer Network said it is horrible.

Michael Marcavage, director of Repent America joined Pike in expressing alarm over the plan.

Marcavage told WND that plan would invert American justice, and instead of requiring evidence it would leave it to someone who claims to be offended to determine whether a "crime" has been committed.

"Truth is not allowed as evidence in hate crimes trials. … A homosexual can claim emotional damage from hearing Scripture that describes his lifestyle as an abomination. He can press charges against the pastor or broadcaster who merely reads the Bible in public. The 'hater' can be fined thousands of dollars and even imprisoned!" Marcavage said.

As WND has reported, such laws already have been used around the world, where in Canada pastors are fearful of reading biblical injunctions against homosexuality, and in Australia where two pastors were convicted of "vilifying" Islam.

Peter LaBarbera, of Americans for Truth, noted that in Canada and France both, legislators have been fined for publicly criticizing homosexuality. Three years ago, a Swedish hate crimes law was used to put Pastor Ake Green, who preached that homosexuality is a sin, in jail for a month.

"And recently, a British couple told how they were denied the chance to adopt because it was determined that their Christian faith might 'prejudice' them against a homosexual child put in their care," LaBarbera added.

Already in the United States, Catholic Charities of Boston halted all adoption operations in the state after being told under Massachusetts' pro-'gay' nondiscrimination law, only agencies that placed children in homosexual-led households would get licensed by the state.

GB SDA ADDRESS FAITH, FREEDOM SINCE 9/11

Church leaders, religious liberty advocates address faith freedoms in Europe since 9/11

Conference of experts analyzes anti-terror laws that could hinder religious expression

Conference delegates included, from right, Deputy Speaker of the House of Lords Baroness Caroline Cox; Lincoln Steed, editor of Liberty magazine; Jonathan Gallagher, Adventist Church liaison to the United Nations; and John Marks, professor of education at the University of Buckingham.

A one-day conference at Seventh-day Adventist-owned Newbold College addressed responses to anti-terrorism laws -- including privacy and hate speech law proposals -- that could affect freedom of religion in the workplace and society.

Church leaders and religious freedom experts met on November 25 for the "Religious Freedom in Europe Since 9/11" conference at Newbold's Centre for Religious and Cultural Diversity.

The roundtable of 40 experts and academics included a member of the House of Lords, professors from the universities of Buckingham and Reading, along with church leaders from the United Kingdom and the church's world headquarters near Washington, D.C.

Some presenters focused on instances of countries adopting or considering hate speech legislation, including religious hate speech. Critics of such laws have said religion should not be exempt from scrutiny.

The group also voiced concern for new resistance to religious practices, including wearing the Islamic veil in some European schools.

"The responsibility for supporting religious freedom lies with all concerned," said Jonathan Gallagher, the Adventist Church's United Nation's liaison. "The denial of religious freedom to another is a denial of religious freedom to oneself."

British House of Lords Deputy Speaker Baroness Caroline Cox described her visits to Nigeria, Sudan and Indonesia and her observations concerning the effects of jihad in those countries. "The Christian churches have been slow to respond to the issue of child slavery and the manipulation of humanitarian aid as weapons of Islamisation," she said.

Don McFarlane, president of the Adventist Church in Great Britain, cited Adventist responses to the sexual orientation legislation in England as a case study to consider the church's response to threats of freedom of belief, especially in hiring practices at church institutions.

McFarlane said he was encouraged to see "a varied group of Adventists -- both professionals and members from different countries showing concern for religious freedom in [the United Kingdom] and abroad. Seventh-day Adventists have a history of taking the lead in this subject and we should continue to do so."

THE UNVARNISHED TRUTH ABOUT ADHD DRUGS

The unvarnished truth about ADHD drugs

You know how I feel about ADHD. I think it's the most over- diagnosed "disease" in the world - one that for the most part has been invented via the re-classification of many types of perfectly normal behavior as abnormal. I also think it's the most egregious example out there of a malady being promoted by drug companies in order to expand the market for their poisons. And usually, the mainstream media has been a more-than-willing accomplice in this heartless and dangerous scam.

That's why it shocked me to read in a mainstream source (CNN.com) an article about yet another downside to the stimulant drugs most commonly prescribed for children "diagnosed" with ADHD. According to the article, several studies suggest that these controversial drugs can have a lasting and negative effect on the developing brain.

Hmmm. That's encouraging, isn't it? Especially for those among the steadily-growing throng of youngsters "diagnosed" with ADHD (up to 5% of kids nowadays) that are PERFECTLY NORMAL - but who've been saddled with a drug habit because their parents aren't up to the task of parenting.

The Harvard-based research featured two groups of animal subjects, medicated at a point in their life cycles that closely approximates human adolescence. One of these groups was given today's most popularly prescribed ADHD drug the other a harmless placebo. Then, later in life, both groups were tested with a battery of behavioral tasks administered under stress.

Not surprisingly (to me), the "drug group" test subjects exhibited a noticeably higher degree of what's known in the mental health field as "learned helplessness," a condition marked by symptoms of depression and a tendency to give up quickly when faced with a challenge. Other, similar research noted that the formerly medicated subjects responded less to rewards and reacted more to stress than the drug-free control group.

What's this mean? It means that these studies point to the likelihood that today's most commonly prescribed psychotropic drugs for a largely made-up disease may in fact cause real and permanent changes in brain chemistry that can affect a person for the rest of his or her life - even long after they've "outgrown" ADHD. The pharmaceuticals giants would no doubt be quick to claim that findings from animal research may not correlate to human beings, but the question I'd ask is this:

Do we really want to take that chance - especially with our children? But what's really scary is that kids aren't the only ones at risk. Keep reading...

And the "truth" as the drug-loving media would have you believe...

In a recent edition of yet another mainstream source (USA TODAY online), a far different picture gets painted of ADHD - this time among adults.

In the December 8th article, which can only be described as a "rave review" for the drug trade, we learn that just like in children, ADHD affects up to 5% of American grown-ups. But here's the kicker: 75% or more of these unfortunate (see also lazy, undisciplined) souls don't even know they have the "disease."

This, according to "researchers" who are never actually named in the piece. Could this be because they're DRUG INDUSTRY sources, perhaps? No, not in a responsible piece of mainstream journalism - perish the thought. This incredible story even goes so far as to credit the marketing machine of the only drug company with an FDA-approved adult ADHD drug on the market (Eli Lilly and Co.) for raising "awareness" about the condition. The article mentions nothing, however, about the PROFITS these campaigns have raised...

And it makes only brief mention of the fact that almost any adult who reads the horribly misleading list of symptoms on the drug's Web site might conclude they were afflicted with ADHD themselves!

What's even more disturbing is this: Many adults nowadays are "discovering" their affliction because of their child's diagnosis (or misdiagnosis, most likely). While hearing all about the symptoms of childhood ADHD, they say to themselves "That sounds like me when I was a kid... "

And viola, another drug-addicted "victim" of ADHD is born! Not bad, huh? One patient walks into the psychiatrist's office (needlessly), but two come out.

As long as the mainstream media acts as nothing more than a free extension of the drug giants' marketing departments, that's the way it's going to be.

Hyper about exposing the hype,
