Gorsuch and Kavanaugh warn lower court judges in Trump cases

In Donald Trump’s long-running feud with federal judges, the president has found some support in an unlikely place: the nation’s highest court.

A growing sense of frustration with some lower courts — articulated in terms that at times sound similar to Trump’s own rhetoric — has crept into a series of opinions this summer from the Supreme Court’s conservative justices as they juggle a flood of emergency cases dealing with Trump’s second term.

“Lower court judges may sometimes disagree with this court’s decisions, but they are never free to defy them,” Justice Neil Gorsuch admonished in an opinion last week tied to the court’s decision to allow Trump to cancel nearly $800 million in research grants.

The rebuke, which was joined by Justice Brett Kavanaugh, flipped the narrative that it is Trump who has pushed legal boundaries with his flurry of executive orders and support for impeaching judges who rule against him. A wave of legal conservatives took to social media to tout Gorsuch’s warning.

“This is now the third time in a matter of weeks this court has had to intercede in a case ‘squarely controlled’ by one of its precedents,” wrote Gorsuch, who was Trump’s first nominee to the high court. (Kavanaugh was Trump’s second.) “When this court issues a decision, it constitutes a precedent that commands respect in lower courts.”

Other conservatives have been just as harsh this year. Justice Samuel Alito in March accused a federal judge in another case involving a Trump policy as committing an “act of judicial hubris” and “self-aggrandizement of its jurisdiction.”

The Supreme Court has been consistently siding with Trump on the emergency docket for months, including in high-profile cases dealing with immigration, spending and the leadership of independent agencies. And Trump has won even in cases in which there are serious arguments that his administration defied a lower court, said Steve Vladeck, CNN Supreme Court analyst and professor at Georgetown University Law Center.

An Astoria lesbian activist long involved in the fight for immigrant rights and the empowerment of New York City lower-income communities was one of two women who confronted Senator Jeff Flake on Friday morning, September 28 just moments after the Arizona Republican, a member of the Judiciary Committee, announced he would vote to confirm Judge Brett Kavanaugh as a Supreme Court Justice.

Ana María Archila, who is the co-executive director of the Center for Popular Democracy, which works with grassroots organizations and labor unions across a broad range of progressive issues, had traveled to the US Capitol on a number of occasions in recent weeks to protest the Kavanaugh appointment. As the Judiciary Committee was preparing on the morning of the 28th to vote on advancing Kavanaugh’s nomination to the full Senate, Archila and another activist, Maria Gallagher of Westchester County, whom she had just met, spied Flake as he was approaching an elevator in the Capitol. They scurried after him.

As Archila held her foot in the elevator’s door, Gallagher, a sexual assault survivor, said to Flake, “Look at me when I’m talking to you. You’re telling me that my assault doesn’t matter. That what happened to me doesn’t matter. That you’re going to let people who do those things into power.”

Archila, who several days earlier, while standing outside Flake’s office, had for the first time publicly told the story of her own sexual assault as a five-year-old child, said to the senator, “You are allowing someone who is unwilling to take responsibly for his actions to sit in the highest court of country. Do you think he is able to hold the pain of this country and repair it? That is the work of justice.”

The exchange was captured and broadcast by CNN.

WASHINGTON, D.C., October 8, 2018 (LifeSiteNews) – A Georgetown University professor who wished “miserable deaths” on defenders of now-Supreme Court Justice Brett Kavanaugh will be taking a leave of absence ahead of schedule, following the university’s initial attempt to quell the controversy by invoking academic freedom.

The Senate voted 50-48 on Saturdayto confirm Kavanaugh’s appointment, following a bitter three-month battleover his abortion views and unsubstantiated, last-minute allegations of sexual assault. Kavanaugh was privately sworn inhours later, and President Donald Trump plans to hold a public swearing-in ceremony Monday evening.

Georgetown security studies professor Christine Fair ignited controversy starting September 29 when she called Kavanaugh’s defenders “entitled white men justifying a serial rapists’ arrogated entitlement,” who “deserve miserable deaths while feminists laugh as they take their last gasps.” She concluded by suggesting “we castrate their corpses and feed them to swine.”

President Donald Trump announced he is nominating D.C. Circuit Court Judge Brett Kavanaugh to the Supreme Court, using a prime-time television address on Monday that will kick off a contentious battle in Washington over the replacement for Justice Anthony Kennedy and the future of the court. Mr. Kavanaugh, if he is confirmed, will be the fifth Catholic on the nine-person court.

Speaking from the White House, Mr. Trump called Mr. Kavanaugh “judge’s judge, a true thought leader among his peers.”

Mr. Kavanaugh, who was joined at the announcement by his wife and two daughters, took the podium after the president and thanked Mr. Trump for his nomination.

During his remarks, Mr. Kavanaugh highlighted his Catholic faith and Jesuit connections.

“The motto of my Jesuit high school was ‘men for others.’ I have tried to live that creed
