Judge won't force disclosure of records on alleged episode with Hunter Biden's gun

A court has rejected a lawsuit seeking to force the public disclosure of federal records about a 2018 episode in which a gun belonging to President Joe Biden’s son Hunter was allegedly thrown in a trash can.

In a ruling Tuesday, U.S. District Court Judge Rudolph Contreras found that the public interest in the handling of any investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives into the episode was “significant,” but that the importance of Hunter Biden’s privacy as a private citizen outweighed the value of releasing any such records to the public.

“The privacy interest here is remarkably strong,” wrote Contreras, an appointee of President Barack Obama.

Contreras’ 24-page decision makes numerous references to an article POLITICO published in March 2021 detailing the bizarre episode in which Biden’s late brother’s wife, Hallie Biden, allegedly found his .38-caliber handgun in his truck, disposed of it in a trash can behind a store and later returned to retrieve it, only to find it missing, according to a police report. Hunter Biden was engaged in a romantic relationship with her at the time.

The Delaware State Police investigated out of concern that the missing gun could be used in a crime, but a man who regularly rummaged in the trash returned the weapon to authorities a few days later, according to the story. Secret Service agents allegedly visited the gun store where Hunter Biden bought the weapon and asked for the purchase records, but the owner declined to provide them, saying the matter was under the ATF’s jurisdiction. He later cooperated with ATF agents.

A copy of the purchase form obtained by POLITICO last year and referenced in the court opinion showed that Hunter Biden checked a box saying he was not at the time a user of, or addicted to, narcotics, despite the fact that he and his family members have said he has struggled with drug addiction for years.

However, no charges were ever brought in connection with the episode.

Hallie Biden and a lawyer for Hunter Biden declined to comment when POLITICO reached out to them last year.

Contreras said Hunter Biden’s discussion of his drug problems in his memoir did not diminish his privacy interest in any records about the episode.

“Disclosure would reveal whether Hunter Biden was criminally investigated by ATF,” the judge wrote. “An individual’s public disclosure of information that could be potentially incriminating in a general sense does not reduce his privacy interest in whether he was the subject of a particular federal criminal investigation by a particular agency.”

Contreras said Hunter Biden’s relation to his father, the president, did not undercut his privacy interest as a legal matter. “The Court is not aware of any case law holding that a private citizen like Hunter Biden loses a sense of personal privacy for purposes of [a Freedom of Information Act exemption] merely by being related to a prominent public official,” the judge wrote.

An Ohio-based blogger, internet journalist and gun enthusiast, David Codrea, requested the records in November 2020 and filed suit in August 2021 after the ATF failed to produce any documents. The Justice Department agency initially told Codrea it couldn’t find any records, then said it was searching for them, then reversed course again and said it would not confirm the existence of any records, offering what is known as a Glomar response.

Codrea filed a similar suit against the Secret Service, but dropped it after the agency said it could locate no records about the episode.

A lawyer for Codrea, Stephen Stamboulieh, declined to comment on the decision. Codrea said in a blog post Tuesday that no appeal is planned.

SPOKANE, Wash. — Matt Shea was 34 years old when he ran for the State Legislature in eastern Washington, but he had already established credentials that made him a promising Republican candidate.

A lawyer trained at Gonzaga University who had served a tour in Iraq with Washington’s Army National Guard, Mr. Shea pitched voters in 2008 on a platform of limiting taxes and punishing criminals, opposing same-sex marriage and supporting gun rights. He went on to win with nearly 60 percent of the vote, then moved up the ranks in the Legislature, reaching the powerful position of chair of his party’s caucus in 2017.

But back in his home district, Mr. Shea also began attracting the attention of law enforcement for his growing embrace of fringe ideologies and conspiracy theories. He networked with local militia groups, talked about plans to create a 51st state called Liberty and distributed to his closest followers a “Biblical Basis for War” document that calls for the “surrender” of those who favor abortion rights, same-sex marriage, “idolatry” and communism. “If they do not yield — kill all males,” it said.

Last week, a report commissioned by the State Legislature asserted that Mr. Shea had engaged in domestic terrorism in his support of the armed takeover of Oregon’s Malheur National Wildlife Refuge by militant ranchers and their supporters in 2016 — part of a protest over federal ownership of public lands in the West.

The scrubby pines and sparsely settled hills of the inland Northwest have long been seen as a potential homeland by fringe white supremacists and armed loners who are militantly suspicious of government power. But for the sheriff here in Spokane County, Ozzie Knezovich, Mr. Shea’s activities are part of a troubling trend: Far-right organizers have begun plying their message of civil conflict in mainstream political circles, building new networks that include elected politicians and voters who would never consider themselves part of an extremist group.

“I think a lot of people underestimate the size and the growth of what’s going on,” said Sheriff Knezovich, a longtime Republican who supports President Trump.

DEBATE RECAP: GOP TALKS $15, INEQUALITY: Fight for $15 got the first question in the GOP debate Tuesday night. “Just outside and across the country picketers are … demanding an immediate hike in the minimum wage to $15 an hour,” Fox Business’ Neil Cavuto said before asking frontrunner Donald Trump whether he supported a minimum wage hike. Trump, predictably, said no. "I would not raise it specifically because I'm interested in making sure that people are able to enter the job market and take advantage of opportunities.”

Notably, Ben Carson changed his position on the minimum wage. Previously he favored legislating an unspecified increase and then indexing it to inflation in the future. Now, apparently, he opposes a raise. He also said minimum wage hikes always increase unemployment. That is not true. Multiple studies have observed instances in which the minimum wage rose and unemployment did not rise. The best-known was a 1994 study by economists David Card and Alan Krueger, both then at Princeton.

We didn’t hear anything about paid family leave or on union rights. The candidates did spend some time on inequality, with Sen. Rand Paul saying Democratic-led states are usually more unequal. It’s actually quite mixed. Today, the District of Columbia is more unequal than all 50 states—and, yes, D.C. is governed by Democrats. But second place (and the most unequal actual state) belongs to Louisiana, whose governor, Bobby Jindal is seeking the GOP nomination for president. Third and fourth place belong to Democratic New York and Massachusetts, but Republican Mississippi and Alabama rank fifth and sixth.

FIGHT FOR $15 AND THE VOTE: Amid the nationwide Fight for $15 protests Tuesday SEIU posted online a voter pledge card promoting a $15 minimum wage, expanded union rights, affordable child care, decent long-term care, activism against racism, and immigration reform. SEIU President Mary Kay Henry said that low-wage workers have “huge” potential to become a significant voting bloc. “I think it’s quite possible to inspire the 64 million workers earning under $15,” she told the Wall Street Journal. But the real target audience may have been lawmakers. “Come get our vote,” McDonald’s worker Laquita Jackson said in statement provided by Fight for $15.

New York Gov. Andrew Cuomo, meanwhile, took executive action mandating that as of 2021 all state workers be paid at least $15 an hour. Pittsburgh Mayor Bill Peduto did the same for city workers. And in Berkeley, Calif., the city council debated an even bigger measure: a $19 hourly minimum by 2020, according to CNN.

McDonald’s workers in Los Angeles said that they weren’t striking for union recognition. “We are striking,” said a letter the Los Angeles Organizing Committee sent a McDonald’s franchisee, “to protest unfair labor practices at numerous locations for which joint employer McDonald’s USA is responsible. We are also striking to demand a $15 an hour wage and the right to join a union without interference. We are not making a present demand for recognition at this time.”

DEMS FIDDLING WITH CADILLAC TAX: Democrats on Capitol Hill are discussing ways to modify the Affordable Care Act’s 40 percent excise tax on expensive (“Cadillac”) health care plans. Unions hate the tax and are trying hard to repeal it before it goes into effect in 2018. "I'm not proposing eliminating it at this point, I’m open to suggestions for changing it," Sen. Dick Durbin told reporters yesterday, according to Reuters. "I don't know if it'll be done this year or next year," Durbin added. "But we're trying to figure out a way to change it or remove it and the impact it would have." http://reut.rs/20LjiZh

Tom Leibfried, legislative representative for government affairs at the AFL-CIO, told POLITICO yesterday that he counted 160 Democrats in the House and 120 Republicans who support repealing the Cadillac tax.

GO WEST, TEENAGER: Is a decades-long decline in job-related migration within the U.S. impeding upward mobility? Much academic and journalistic research suggests it is, including a recent paper by Jason Furman, chairman of the White House Council of Economic Advisers, and Peter Orszag, former White House budget director. Morning Shift’s Timothy Noah wrote about this two years ago in the Washington Monthly, and Eli Lehrer and Lori Sanders wrote about it last year in National Affairs. Now Scott Winship of the conservative Manhattan Institute weighs in.

Winship concludes “we should be less concerned than we are about declining migration” because the only type clearly associated with upward mobility is that of young people between adolescence and adulthood--and that hasn’t declined at all. GIG COMPANIES BEGIN LOBBYING OVER ‘PORTABLE BENEFITS:’ Representatives of “sharing economy” companies like Lyft, Handy and Airbnb have been journeying to Capitol Hill to discuss employment law with a group of bipartisan lawmakers, Bloomberg BNA reports. The companies are likely feeling heat from the Labor Department’s ongoing scrutiny of misclassification in the U.S. workplace and from scores of private class action lawsuits targeting tech companies. Now these companies are urging lawmakers to adopt a “regulatory ‘timeout’ in which employers can tinker with worker classification without running afoul of federal laws,” BNA writes.

“Company representatives told caucus members that they’d be interested in expanding their relationship with workers, but are concerned about the increased cost and potential liability that comes with having full-blown employees.” http://bit.ly/1M4LPkP

Meanwhile, earlier this week an eclectic group of workplace advocates, local union leaders and tech CEOs released a statement calling for a “portable benefits” system to help independent contractors and freelance workers gain the benefits normally confined to full time employees.

Will union leaders in Washington get on board? We’re not so sure. Unions may feel reluctant to create a portable benefits system while they negotiate those same benefits for their members. We also wonder whether we’ll soon see a turf war between non-union worker advocacy groups like the Freelancers Union — whose president Sara Horowitz is a signatory to the “portable benefits” letter — and more traditional unions over the future of the law and the workplace.

UNIONS SPENDING BIG TO KILL RIGHT TO WORK IN MISSOURI: About two months ago a cohort of Democrats and Republicans teamed up to oppose right-to-work legislation in Missouri. The bill passed the legislature, but Democratic Gov. Jay Nixon vetoed it. Unions aren’t resting easy after that victory; they’re already spending heavily to head off right to work in 2016.

The Carpenters’ District Council of St. Louis & Vicinity plans to spend $400,000 by years end on candidates, both Democratic and Republican, who oppose right-to-work legislation that frees non-union members from paying fees to unions that bargain collectively on their behalf.

Labor leaders caution that “unions won’t be able to compete dollar for dollar with the individual megadonors who support right to work,” writes the Kansas City Star’s Jason Hancock. “For example, a recent analysis of campaign finance data by the Star showed conservative businessman Rex Sinquefield has donated more than $22 million since 2010 — three times as much as the next biggest donor.”

More Evangelicals Are Embracing Gay Marriage

Evangelical Christians, who in the past have been staunchly opposed to gay marriage, are changing their minds about the issue, and there has been a notable increase in the number who now support it.

According to Politico Magazine, some evangelicals are embracing same-sex relationships in church sermons, conferences, and books, arguing traditional scriptural interpretations of gay marriage are misguided and outdated, just as many other cultural

"We must prepare people for what the future holds, when Christian beliefs about marriage and sexuality aren't part of the cultural consensus but are seen to be strange and freakish and even subversive," Russell Moore, chief political spokesman for the Southern Baptist Convention, wrote in an April blog post, according to Politico.

Evangelical support for gay marriage has more than doubled over the past decade, according to polling by the nonpartisan Public Religion Research Institute, Politico reported. One expert predicts those views will only become more common in the coming years.

"Evangelicals will more or less come to embrace homosexuality in the next 20 to 30 years," Jeremy Thomas, an Idaho State University sociologist who has studied conservative Christians' changing attitudes toward homosexuality, told Politico. "I would put all my money on that statement."

Meanwhile, some Christian pastors and advocacy groups have chosen to tone down their rhetoric on the issue. Renowned evangelical Pastor Rick Warren, for example, apologized for endorsing California's Proposition 8, though has stopped short of supporting laws allowing same-sex marriage.

Republican politicians are also backing down on the issue, according to Politico. In some cases, it's a matter of declining to publicly engage or campaign on the issue. In other instances, evangelical groups have chosen to back down from introducing new ballot measures banning same-sex marriage in the 31 states where it continues to be illegal.

An additional influence on changes in attitude has been the recent publication of books by theological academics disputing traditional interpretations of Scripture that insist the Bible is opposed to gay marriage.

Nevertheless, many evangelicals still support traditional church teachings on homosexuality and insist the fight must continue against changing cultural attitudes, according to Politico.

Gay marriage is now legal in 19 states plus the District of Columbia, and all major public opinion surveys indicate that a majority of Americans now support it, Politico noted.

Mayors hail Hillary Clinton for 2016

Even before President Barack Obama starts his second term, some of the nation’s Democratic mayors have come close to settling on his successor: Hillary Clinton.

Mayors interviewed by POLITICO at the U.S. Conference of Mayors meeting in Washington, D.C., were effusive about the secretary of state, although some waved off questions about 2016. While few were ready to commit to her candidacy before she has even left Foggy Bottom, their praise leaves little doubt about Clinton’s level of support from local officials.

And of course, Clinton needs to decide to run before she can get an endorsement.

“She says she’s too tired to run,” said Frank Ortis, the Democratic mayor of Pembroke Pines, Fla. “I’ve known the first lady for a long time, the secretary. And if that’s her choice, God love her, she’s done so much. She’s traveled more than anyone. But I do love her as a leader. If she were to run, I would support her. I just think she’s so tired.”

Clinton also earned praise from the mayor of the second-largest city in an early primary state.

“She would be a very fine candidate,” said Joe Riley Jr. of Charleston, S.C., the nation’s longest-serving mayor, having been in office since 1975. “Always you wait to see who the candidates are, but I’m a great admirer of Secretary Clinton. She’s been a fabulous secretary of state. Amazing.”

Riley endorsed President Barack Obama in the 2008 primary.

The praise of Clinton from the mayoral ranks matches her early support from rank-and-file Democrats. A December ABC/Washington Post poll found 57 percent of Americans want her to run in 2016. An overwhelming 61 percent of Democrats said Clinton was their top choice in a Public Policy Polling survey the same month.

Much of the goodwill for Clinton can be traced to that unsuccessful 2008 run — which gave her the opportunity to meet mayors from across the nation — and how she handled its aftermath.

“She has served with great distinction,” Gary, Ind., Mayor Karen Freeman-Wilson said. “She took a hit [four years ago] when she did not get the nomination, but did she it with such grace and dignity, that it would be hard for her not to be picked. I would be glad to support her.”

Mayor Raul Salinas of Laredo, Texas, endorsed Clinton in 2008, during a campaign in which she visited the border city of 200,000.

“I think with her background, her vast experience, I mean, she is an all-around, well-seasoned, somebody that would do an outstanding, a remarkable, I don’t have enough adjectives to say, she would be a brilliant president,” Salinas said. “I think she’s wonderful, she’s wonderful. Look what she’s done in her capacity, the confidence the president has in her; she has done an amazing job.”

He added later: “When you open up the dictionary and see ‘statesman,’ you see Hillary Rodham Clinton on that stage.”

But Salinas called POLITICO later to praise another potential 2016 contender who had just addressed the mayors: Vice President Joe Biden.

“I think it’s kind of premature, we have to make sure, the president, he just started his second term, it’s a long time down the road,” he said. “We have a good core of people that would be able to lead this country. [I also] can’t take anything away from Vice President Joe Biden. Wow, the experience he has, a good working relationship with local people.”

Disgraced Liberal Journalist Teaches Media Bias at Georgetown

Disgraced journalist David Chalian has been hired as the new Vice President for Video Programming at Politico, despite being fired by Yahoo! News for making a vicious “joke” accusing the Romneys of hating black people. A quick look at the syllabus for the course he is teaching at Georgetown University may explain why. His course requires the “daily reading” of Mike Allen’s “Politico Playbook” column in particular and instructs students to read Politico itself on a regular basis.

Chalian had been heard on an ABC News video [1] claiming that GOP presidential candidate Mitt Romney and his wife Ann were unconcerned about black people getting hit by Hurricane Isaac during the GOP convention. “They aren’t concerned at all,” he said. “They are happy to have a party with black people drowning.” Laughing could be heard as the “joke” was made.

Georgetown is the nation’s oldest Catholic university, while Politico is a publication with a definite left-wing bent. The Daily Caller notes [2] that Politico’s writers “have had a penchant for viewing those on the political right through a harsh prism.”

A course syllabus for “Political Reporting: Road to the White House” is not publicly available on the website for the class [3] but we found a copy [4] on the Internet. The course can be counted toward a “Master of Professional Studies in Journalism” and is taught by Chalian in conjunction with Brooke Brower [5], the senior producer for MSNBC’s “The Daily Rundown with Chuck Todd.” Brower was previously a producer for “Hardball with Chris Matthews.”

MSNBC is also considered a left-wing news operation.

An item on the “Required Viewing” part of the course is the HBO propaganda film, “By the People: The Election of Barack Obama (2009) [6].” One of the filmmakers said [7] about the project, “I think my hope for it, too, is that people will see it and be re-inspired to be part of the democratic process again. I think that it was an amazing time for this country.”

Georgetown University still lists [8] Chalian on its faculty as “Yahoo! News Washington bureau chief,” even though he was fired back on August 29—more than a month ago. The news organization said at the time that “David Chalian’s statement was inappropriate and does not represent the views of Yahoo! He has been terminated effective immediately.”

Georgetown’s failure to identity Chalian as having been fired from Yahoo!, and the unprofessional conduct that got him fired, seems to fall far short of the high standards of honesty and integrity required of students. The students at the prestigious institution “are expected to maintain the highest standards of academic and personal integrity” and sign a Georgetown University Honor Pledge that affirms “academic honesty.”

It says, “In the pursuit of the high ideals and rigorous standards of academic life, I commit myself to respect and uphold the Georgetown University Honor System: To be honest in any academic endeavor, and to conduct myself honorably, as a responsible member of the Georgetown community, as we live and work together.”

Politico Editor-in-Chief John Harris announced [9] his hiring, saying that while Chalian had “screwed up” by making the racial attack on the Romneys, it “did not reflect his personal views or professional standards.” He did not explain how he knew this was the case. Harris added that Chalian was “superbly well-qualified to help us achieve a strategic goal that is very important for Politico.”

A writer at Red State called [10] Chalian a “bigot” and added, “I’m sure he is a great fit for a reflexively biased publication like Politico. And to the extent that their ‘strategic goal’ is patently dishonest reporting on Republicans and conservatives I’m sure Chalian will be an ideal fit.”

At the time that the story broke about Chalian’s comments, Rush Limbaugh noted his affiliation with Georgetown, saying [11], “Well, I said he sounded like a kid. I assumed that because he’s at Yahoo, that he’s a kid. He’s not. This guy is an adult. He’s been around for years. In addition to that, he teaches a master’s degree class at Georgetown. He teaches a master’s degree class, Master of Professional Studies in Journalism, at Georgetown. So he’s an objective journalist. Exactly right. He’s a teacher. I erred when I said this kid is just repeating what he’s been taught. This is what he’s teaching! It’s even worse than I thought. This is what he’s teaching.”

Now we know that Chalian “teaches” the left-bias at Politico as something to be read, understood, and appreciated by his students. This may help explain why he is now working there.

But it doesn’t explain why his faculty bio [8] at Georgetown hasn’t been updated to reflect his firing from Yahoo!

Who's minding the store?

While President Obama is crisscrossing the nation on a continual reelection campaign, who's minding the nation's affairs? Who's minding the store?

At a time when Russia and China are poised to defend Syria from an invasion to depose Al Assad, or intercede in the event of a preemptive nuclear attack on Iran; The American President is indisposed in domestic politicking, attempting to perpetuate his tenure at the helm.
